Even if AILA loses the lawsuit, it will bring this entire incident to the limelight. The best thing we can expect out of it is media attention which unfortunately is not available to our cause at this time.

I can read and feel the anger and frustration. But I have seen this every time a retrogressed visa bulletin was released in last ten years. Appeals for unity and and urgent need for action. However, it turned out to be a storm in a tea cup. Hope its gonna be different this time.

I don't think the Canadian officers will ask you that question. But like someone else said on this thread that question may be raised by the US officers when you return. I am curious to know about this myself.
Aslo (I don't want to scare you but thought you ought to know) there's another discussion going on here http://immigrationvoice.org/forum/showthread.php?t=17061 where the US officers at POE in SF airport raised an issue saying that AP can be only used for imergencies. This looks more like an isolated case but I want everyone to be aware of that case.
In my case, i do not have a valid H-1B visa stamp. I recently visited India and used Advance Parole. Questions related to this
1) do i need to surrender my PAROLE I-94 before departing USA?
2) does canada immigration officer ask me why i have applied for canada gc while my USA gc is in process?:confused:

I also want USCIS to count my legal presence in the US prior to obtaining permanent residency (GC) for naturalization purposes. (Canada does this - 50% credit for time spent legally before obtaining permanent residency).

I am not againist H4 guys but i can't help but laugh when H4 guys complain that they were being treated bad by not allowing them to work.
One has to understand that US allows ppl on a certain basis and H4 is nothing but to join your spouse (or something like that for kids).
One can request them to make a provision for H4 ppl to work but blaming that they haven't done that simply by fogetting on what basis they entered US.... hmmm i don't know.
Questioning their speed of process and other irregular rules... yes i am with you but blaming them for above ... i don't think that is fair.
I wonder how many who come here on H4 know what complexities lay ahead in the G.C processing. unfortunately it is not easy to undo their marriage and go back.
They need a fair deal too just like the way those in EB-3 are waiting for a proposal that addresses their issues more directly rather than trickle down. I guess u r one of them.

I have a fundamental question here. What exactly has to happen to actually say that the CIR has died? Will the house have to vote and kill it? I guess there are no legal time lines for a bill to lapse - or is there one? Does the bill automatically die when the present congress' term ends?

I don't think there is a specific age where they will taken finger prints. Read my story.
My 15 yr old was the first to receive the notice. She was not in US at that time. I called the USCIS and informed them about this. They said they will postpone the appointment. But the postponement was only for 2 weeks. With the next notice I went to the local office. The security officer gave me a print out stating that I visited there for this reason. AND ACCORDING TO THAT NOTICE, FINGER PRINTING CAN BE DONE WITHIN 64 DAYS FROM THE ORIGINAL NOTICE. My child came back to US in 60 days and I took her to the local office walk in date. He got finger printed.
The very next week my 9 yr old got the notice. I took another appointment and next day I got a second finer printing notice for my elder one again. I took both of them to the local office and explained the situation. For my second child they did the finger printing and for my elder, they made a stamp on to the latest notice which was not at all clear.
Me and wife was never requested for a second finger printing. We all just got GREENED on August 6th.

My wife got EAD approved on 16th Aug and I got my approved today. I do not know why 10 days of delay.
One thing I noticed is within last week or so, lot of people are receiving EADs and I485 processing is slowed down. I think now they are concentrating on EADs and come sept they will again jump to 485s. Just a guess!
