Question to IV core...
After receiving the standard email respose from the congressman/senator...I am wondering are they even aware about the legal immigrants. All we are getting the standard template which is talking about only illegals and DREAM.
No mention about legals ?
Please read my earlier responses on this thread. We need to now take up this issue further and tell them we did not get satisfactory response and need serious attention to our issue as a constituent.

I think we all understand we are in this together. No doubt.
A single post from CORE IV can make a huge difference to herd the cattle (including myself) here. For Instance, AILA letter asking for H1B and EB relief today.
I had posted a modified version of their letter in our forum in which I had deleted asking for raise in H1 and retained only EB part. IF IV core thinks
this is a good (or a bad ) idea and suggests what to do, our members will be energized.
For my part, I have added my personal story, added the EB relief part of AILA letter and emailed two senators and one congressman in my state.
Also, the same letters signed are ready in an envelope to be snail mailed.
So, IV core, from time to time, when there is a campaign by AILA and other organizations which could help us, please suggest how you would like us to proceed.I am not trying to create more work for you, but as a member, I think it would benefit all of us.

Your idea is good and I would encourage you to go ahead and send such letters to lawmakers. Any effort that is in line with IV's agenda and helps us in any way will be helpful to all of us. IV endorsed efforts are listed in action alerts page. If you choose to go and meet the lawmakers we have put together all information for this purpose

When the session starts I am sure based on where the issues are going and after consultation with QGA and within core team there maybe some action alerts that involves contacting lawmakers.
Your efforts sending letters to lawmakers will certainly help us in raising awareness and preparing groundwork for coming months.

ok. Assuming BILL pass during the lame-duck session... what is timeline for it take effect? I believe the president has to signed it and it take 90 days from that date to be effective? Experts?
Any stratergic ideas, if positive news does not come out during the lame duck session?
I did not know it takes 90 days; that is too long a period of time. But nobody is hopeful of the bill getting passed during the lame-duck session.

Though they didnot break any law in writing, they had the intent to not give any relief to people who are eligible to apply in july as per the old bulletin.
The intent itself is ulawful.
Alos in rushing to use all the visas, they might have given visas prematurely to applicants who had no clearence.
The only thing we could do guys , is to get a lot of media attention , make the whole world know about our problems....

They did nothing wrong legally , its a tradition that DOS doesnt change the visa bulletin in a month..ITS NOT A LAW.
The max we could get from a lawsuit is damages(financials) , and as USCIS is a fees funded organisatiom , its gonna come back to us
In one way we should be happy that the USCIS is cleaning its internal backlog,

I had to travel back home so I called customer service to find out if I could get FP notice earlier so that I could do FP before departure.
Called Customer serivce on November 20th 2007, he generated a SR for me and then there was scilence for next 30 days.

But i agree with the post above .. we are really stuck between a rock anda hard place on this issue..If we ask them to move all spouse visa numbers to Family , which is how it should be based on the legislations you are quoting, then our partners will have to wait for more number of years than EB categories. It does not matter that EB3 is now U. my feeling is in the long run EB is a better category than FB....
Also it could present more issue for all those aged out folks who are at least in EB where the gravy train seems to be inching unlike the FB train... And we don't even need to scenario plan the FB if all our spouse appln goes in to taht bucket.. But there is an advantage.. the primary applicant could get their GC cards faster (I am assuming) and this probably may be truer (if there is anything like that) for India and China, where usually the EB applicantion includes spouse/child visa reequest as well..

Let's NOT be hypocrites. We are just venting out our frustrations of these never ending Visa Bulletin life...
We all know that we respect each other and value much more than these occasional emotional outbursts. Donors or Non Donors, USCIS treats us as same shit.
My take would be, if people want to Donate or find that their Donation could help their cause, they will Donate. We can only request people to Donate and put forth our 'Selling points', which I think Pappu, Ameya and others are doing it already.
Please don't stoop down to the level of hating each other on the basis of 'Donor' Vs 'Non-Donor'.
I honestly, think IV should rename that to 'Paid member' or 'Privileged' or 'Subscriber', IMHO, it's NO DONATION. People Donate because they expect something in return...we all want other to donate so that we can have bigger impact, but this is definitely NOT the way to go about it.

USCIS can't consume or approve more than 10% of annual limit which is 14,000 per quarter. However this is not applicable for last fiscal quarter. DOS intention is good to make the current in July so that no visa goes in vain. Evil USCIS woke up and approved in two weeks so that rest of the ppl can file next year with higher fees.

I send my Employment based I-485/I-765/I-131 application on June 29th 2007 and received at NSC on July 2nd 2007 (USPS Express mail tracking no. XXXX). It�s more than 100 days and I didn�t even received the Receipt Number for all the applications.
I have following question for CIS Ombudsman�s office:
1) Per US Law, I have to get the EAD in 90 days of filling of my application? How I can get the EAD in 90 days where I didn�t even get the Receipt Number after 100 days?
2) Why �First In First Out (FIFO)� process is not followed by USCIS for receipting? It�s unfair to applicant like me when application filed on August 17th 2007 enjoying the EAD card and able to work.
3) What action you can will take to force USCIS follow their own operational manual guidelines and follow FIFO in future?

Guys,
I just got my H1B Extension approved (8th year extension).
Original H1B was valid until Sept 2008. Changed companies after 180 days(of I485 application) and applied for H1 transfer and extension for 3 years via new company. Finally got it approved after 3 months for 3 years(until May 2011).

Under the circumstances we might like to approach the Hon'ble President by posting a well drafted letter (not more than a page). Let us see what happens. All letters should be posted withing a specific pre-determined time frame (within one week, say from June 1 to June 7) to create an impact. We might like to achieve a target of say 250,000 letters. This cannot go unnoticed.
The law suit option is not bad but probably would need serious consideration. The suit will have more impact if we first send the letter. Atleast then we will have a point in our favour - that we have been driven to wall with no option but to fight legally.
As a starting point can some of us come up with some convincing drafts? We could eventually come up with a good final draft.
Obama was the only person who did make a mention of the problems faced the legal immigrant community during the campaign. We need to highlight this too.

maybe not. but does prevent the things that life is worth living for.
imho coming to the US was the worst mistake of my life. it took me about 5 years to see through the lies that the system, the employers and other desis propogate regarding h1 and prospects in US.
you can't get fair treatment as long as you are on h1. that is why the others will not let you get out of h1.

It seems like the deeper we are in the process of GC the more time we spend tracking and speculating on the next week or the week after.
This week is going to be critical for the Notices because if we don't get them by 8/17 the following weeks are going to be even worse.
I'm tempted to call because of the time that has passed and becasue my checks also are dated 6/15.

We are privy to some information and we were told that Sen. Cornyn might introduce this to the senate today. When we say might, it means that there is a good chance he may not do so too!
And introducing just means that he will get a number assigned to it. It will NOT be debated today. The debate timeframe is decided by the majority and minority leaders Frist and Reid respectively.
We just wanted to share with you what we learned. When we learn more, we will let you guys know. For right now, all we know is in the first post.
And FYI, there are some decent provisions in this bill especially related to STEM. Also presents a solution to retrogression wherein Adjustment of Status would be possible in spite of no visa being available.
